한국의 역사적 이주민 집단인 화교, 특히 2세대 이후는 한국에 태어나 준내국인화 되어 살아왔지만 현실은 여전히 국민이 아닌 체류자, 혹은 외국인의 자격에 머무를 수밖에 없었다. 이주민 관련법의 전면 개정 전까지 한국정부의 외국인에 대한 법적 규제와 관리 정책은 화교의 일상적 삶 속에서 강하게 작동되어 불안정한 신분과 추방가능성의 공포, 합・불법의 모호한 경계에 대한 불안정한 방식의 대처 등으로 나타났다. 귀화와 같은 법적 시민권의 획득은 그동안의 구조적 취약성을 벗어날 수 있을 뿐만 아니라 한국인의 차별적인 시선에서 자유로워지고 한국 국민과 같은 복지혜택의 수혜와 자유로운 해외여행의 편의를 얻을 수 있는 좋은 방법이다. 그러나 귀화희망자가 늘어나면서 귀화적격심사가 점차 까다로워지고 연령 편향적인 경우가 많아 노년 화교에게는 또 다른 차별과 소외감으로 다가온다. 이들은 한국 사회에서 당연시 여겨온 혈통주의에 따른 국적부여가 실제로는 모호한 것이며 자신들처럼 태어나고 자랐으며 거주국에 대한 의무에 충실하고 한국을 정체성과 소속감의 중심에 두는 것 보다 더 확실한 귀화의 조건은 없다고 생각한다. 이러한 노년 화교의 인식과 성찰은 거주국에서 출생한 이주민의 정체성 및 소속감이 법적 시민권과 밀접한 관련이 있으며 일상에서도 중요한 의미를 지니고 있다는 점을 잘 보여주고 있다.Overseas Chinese, a group of historical migrants in Korea, especially after the second generation, were born in Korea and lived as quasi-nationals, but in reality, they still had no choice but to retain the qualifications of sojourners or foreigners. Until the full revision of the migrant-related law, discriminatory legal regulations and management policies for foreigners of the Korean government strongly affected the daily lives of overseas Chinese. As a result, the overseas Chinese have suffered from unstable status and fear of possible deportation, and have dealt with unstable methods such as evasion of the law in the ambiguous boundary between legal and illegal. Acquisition of legal citizenship, such as naturalization, is a good way not only to escape the structural vulnerabilities of the past, but also to be free from the discriminatory gaze of Koreans, and to benefit from the same welfare benefits and freedom of overseas travel as Korean nationals. However, as the number of naturalization applicants increases, the naturalization eligibility screening process becomes stricter and in many cases it is age-biased. This brought another sense of discrimination and alienation to the elderly overseas Chinese. They believe that the granting of nationality based on jus sanguinis, which has been taken for granted in Korean society, is ambiguous, and that there is no more certain condition for naturalization than being born and raised like them, being faithful to one’s obligations to the host country, and placing Korea at the center of their identity and sense of belonging. This recognition and reflection of these elderly overseas Chinese well demonstrate that the identity and sense of belonging of migrants born in the host country are closely related to legal citizenship and have an important meaning in everyday life. 줄이기
